Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and the operator of Garantex.app (“Garantex.app”, “we”, “us” or “our”) and govern your access to and use of the Garantex.app website, the exchange service and every related feature, page and support channel (together, the “Service”). Please read them carefully. By creating an exchange, making a card purchase, opening a support ticket or otherwise using the Service you confirm that you have read, understood and accepted these Terms, our Privacy Policy and our AML/KYC Policy, which form part of these Terms. If you do not agree, do not use the Service.

1. Definitions

  • Exchange – a single order to convert one digital asset into another, or a card payment into a digital asset.
  • Deposit – the digital asset or card payment you send to us to fund an Exchange.
  • Payout – the digital asset we send to the recipient address you provide.
  • Exchange ID and PIN – the identifier and 6-digit code issued for each Exchange. Together with the private exchange link they are the only credentials for that Exchange.
  • Network – the blockchain on which an asset is sent (for example Bitcoin, Ethereum (ERC20) or Tron (TRC20)).
  • Deposit window – the period shown on the payment page within which your Deposit must arrive.
  • Standard mode / Anonymous mode – the two data-handling modes described in section 7.

2. Eligibility

To use the Service you must:

  • be at least 18 years old and have full legal capacity to enter into a binding agreement;
  • be legally permitted to buy, sell, hold and exchange digital assets in the country where you live and from which you access the Service;
  • not be located in, a resident or national of, or acting on behalf of anyone in, a country or region subject to comprehensive sanctions;
  • not be listed on, owned or controlled by anyone listed on, any sanctions list applicable to us (including the UN, EU, UK and US lists);
  • act on your own behalf and not on behalf of a third party, unless you have told us so in advance and we have agreed.

We may refuse or stop providing the Service to anyone at our discretion, in particular where we believe these requirements are not met.

3. The Service

Garantex.app is an instant exchange service. We convert one digital asset into another, or a card payment into a digital asset, and deliver the result to the wallet address you choose. We do not provide user accounts, wallets, custody of balances, investment advice, margin, lending or any other financial product. Funds are handled only for as long as needed to complete the Exchange you requested.

Exchanges may be processed by our team, automatically, or with the help of liquidity providers and payment partners. The assets, networks, pairs and limits available can change at any time without notice.

4. How an Exchange works

  1. Quote. You choose the assets and amount. Before you confirm, we show the estimated amount you will receive, the rate, the service fee, the network fee and an estimated processing time.
  2. Details. You enter the recipient address (and Memo/Tag where required) and, optionally, a refund address. You are shown your Exchange ID and PIN once – save them together with the exchange link.
  3. Deposit. You send exactly the asset, on exactly the network, to exactly the deposit address (and Memo, if shown) displayed on the payment page, within the deposit window.
  4. Processing. After your Deposit receives the number of network confirmations we require, we complete the conversion and send the Payout. Estimated times are indicative and are counted from the moment your Deposit is confirmed.
  5. Completion. The Exchange is complete when the Payout transaction has been broadcast to the network.

If no Deposit arrives within the deposit window the Exchange expires automatically. A Deposit that arrives after expiry, in a different amount, in a different asset or on a different network is handled under section 11.

5. Rates and price changes

The rate shown on the payment page is guaranteed for Deposits that arrive within the deposit window in the quoted amount. Digital asset prices are highly volatile. If your Deposit arrives late or in a different amount, we may recalculate the Exchange at the rate available when the Deposit is confirmed, or refund it. We may pause quotes for an asset when reliable price data is not available. In case of an obvious pricing error (for example a rate that clearly deviates from the market because of a technical fault) we may cancel or correct the affected Exchange and refund the Deposit.

6. Fees and limits

  • Service fee – a percentage applied to every Exchange.
  • Anonymous mode fee – an additional percentage in Anonymous mode. It depends on the USD value of the Exchange and is shown on the home page and in the quote.
  • Card fee – an additional percentage for card purchases, covering payment processing costs.
  • Network fee – a fixed amount in the received asset that covers the cost of sending the Payout.

All fees are included in the amount shown before you confirm; there are no hidden charges from us. Your own wallet, exchange or card issuer may charge separate fees (for example sending fees or foreign transaction fees), which are your responsibility. Minimum and maximum amounts apply per asset and per card order and are shown in the exchange form. Amounts below the minimum may not be processed or may only be refunded, minus network fees.

7. Standard mode and Anonymous mode

In Standard mode we store technical information such as your IP address and browser details together with the Exchange, and you may give an e-mail address for status notifications. In Anonymous mode we do not store your IP address, browser details or e-mail address with the Exchange; you track it only with your Exchange ID, PIN and link. Anonymous mode carries the additional fee described in section 6 and may not be available for card purchases.

Anonymous mode is a data-minimisation feature. It is not a way to avoid the law: Exchanges in either mode are subject to the same screening, may be put on hold and may require verification under our AML/KYC Policy. Details are set out in our Privacy Policy.

8. Card purchases

Card purchases are processed by an independent payment partner. By paying by card you also accept the partner's terms and privacy notice. The partner may require verification, 3-D Secure authentication or additional information and may decline a payment at its discretion. We cannot see or store your full card details. The digital asset is sent once the payment has been confirmed by the partner. Chargebacks raised after the Payout has been delivered may be disputed and, where the purchase was legitimate, may be treated as a breach of these Terms.

9. Your responsibilities

  • You are solely responsible for entering a correct recipient address, selecting the correct network and including the correct Memo/Tag where required. Blockchain transactions are irreversible; we cannot recover funds sent to a wrong address, network or without a required Memo.
  • You must send your Deposit from a wallet you own or are authorised to use, and the funds must come from a lawful source.
  • You must keep your Exchange ID, PIN and exchange link confidential. Anyone who holds them can view the Exchange and contact support about it. We are not responsible for losses caused by you sharing them.
  • If you receive to an account at another exchange or custodian, you are responsible for checking that it accepts deposits of the asset on the chosen network.
  • You must provide true, complete and up-to-date information whenever we ask for it, including during verification.
  • You are responsible for keeping your devices, wallets and private keys secure.

10. Compliance, holds and verification

We screen Exchanges automatically and manually. We may put any Exchange on hold – before or after the Deposit is received – and request identity verification (KYC), source-of-funds information or other documents in accordance with our AML/KYC Policy. This applies to Standard and Anonymous mode alike. While an Exchange is on hold the rate is not guaranteed, and processing times do not apply. If you refuse or fail to complete verification within a reasonable time, we may refund the Deposit to its source or to a confirmed refund address, minus network fees, where the law permits. Where the law requires it, we may freeze funds, refuse a refund and report the matter to the competent authorities, and we may be prohibited from telling you why.

11. Refunds

  • Refunds are sent in the asset and on the network of your Deposit, to the refund address you provided or to an address you confirm through support, minus network fees.
  • A refund may be made if the Exchange cannot be completed, if the Deposit arrives after expiry or in a different amount and you choose not to proceed at the new rate, if an asset or pair becomes unavailable, or in the cases described in sections 5 and 10.
  • Deposits sent in an unsupported asset, on an unsupported network or without a required Memo may be impossible to recover. Where recovery is technically possible, it is done on a best-effort basis and may incur a handling fee in addition to network costs.
  • Card purchases are refunded according to the payment partner's rules, generally to the card used for payment.
  • We do not refund completed Exchanges because of later price movements.

12. Prohibited use

You must not use the Service, directly or indirectly, for or in connection with:

  • money laundering, terrorist financing, proliferation financing or sanctions evasion;
  • fraud, scams, ransomware, theft, hacking, extortion or the proceeds of any crime;
  • darknet markets, illegal gambling, illegal drugs or weapons, or any other unlawful goods or services;
  • deliberately splitting amounts or using multiple Exchanges to avoid limits, screening or verification;
  • using stolen cards, someone else's card or identity, or providing false documents;
  • attempting to interfere with the Service, probe or break its security, or guess Exchange IDs and PINs;
  • automated access to the Service beyond normal personal use without our written permission.

We may refuse, stop or reverse any Exchange that we reasonably believe breaches this section, and we may report it to the authorities.

13. Availability, maintenance and delays

We aim to keep the Service available at all times but do not guarantee uninterrupted operation. We may pause new Exchanges for maintenance, security reasons or market conditions. Blockchain congestion, forks, network upgrades, failures of third-party wallets, nodes or partners, and compliance checks can delay an Exchange. We are not responsible for such delays, but we will complete or refund affected Exchanges as soon as reasonably possible.

14. Third-party services and links

The Service relies on blockchains, wallets, liquidity providers, payment partners and other third parties that we do not control. Logos and links to partners or other websites are provided for information only; we are not responsible for their content, availability or practices.

15. Intellectual property

The Service, including its software, design, texts and trademarks, belongs to us or our licensors. You may use it only for its intended purpose. You may not copy, modify, distribute or create derivative works from any part of it without our written consent.

16. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, uninterrupted availability or that any asset will keep its value. Nothing on the Service is investment, legal or tax advice.

17. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, loss of profit, loss of opportunity or loss caused by price movements, network delays, blockchain failures, third-party services, or incorrect information provided by you. Our total liability for any claim relating to an Exchange is limited to the amount of the service fee we charged for that Exchange. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or gross negligence.

18. Indemnity

You agree to compensate us for any claims, losses, fines and reasonable costs (including legal fees) arising from your breach of these Terms, your breach of any law, or your misuse of the Service.

19. Taxes

You are solely responsible for determining, reporting and paying any taxes that apply to your Exchanges. We do not provide tax advice.

20. Suspension and termination

We may refuse, suspend or cancel any Exchange, or block access to the Service, if we suspect a breach of these Terms, a legal or regulatory requirement, a security risk or fraud. Where we do so before completing an Exchange, we will refund the Deposit in accordance with section 11 unless we are legally required to act otherwise.

21. Changes to these Terms

We may update these Terms at any time, for example to reflect changes to the Service or the law. The updated version is published on this page with a new “Last updated” date. The version in force at the time you create an Exchange applies to that Exchange.

22. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the operator of Garantex.app is established, without regard to conflict-of-law rules. Before starting any formal proceedings, please contact support so that we can try to resolve the issue amicably; most issues are resolved within a few days. Mandatory consumer protection rules of your country of residence remain unaffected where they apply.

23. Miscellaneous

If any provision of these Terms is found invalid, the remaining provisions stay in force. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms without our consent. If these Terms are translated, the English version prevails in case of conflict.
